    your wife's application should be tied to your PD. If you got it in EB1, then she too should be in EB1. The pearson memo will help. Get an infopass and clarify the issue.

    Hi..
    i am currently on my 8th year h1..and on the bench..hoping some projects will come thru in a week or so.

    Currently i have been on LOP for almost 5 weeks now..
    what do you think would be a good option for me:

    a.) Start the process for H4..and find a new job..and transfer H1 and stay till H1 is valid till may 2010..

    b.) Be on bench for few more weeks.. and hope someting will work out...(firm has said they wont cancel my h1/140).. they are just being helpful..but?

    c.) R2I ASAP...and try for a consular processing....?

    d.) go to H4...and R2I in May...then if the Eb2(Dec 2005) dates are current..try for a CP..its a long shot...


    i am confused..any suggestions??

    I am pending adjustment of status but my company has recently moved me abroad. My EAD is expiring in July and AP in Oct. I am planning to travel to the states next week on my AP to file for a renewal for both.

    My concern is the fingerprinting notice for both. During my last EAD renewal or AP renewal, i was not called for a fingerprinting. Do you know under what circumstances a fingerprinting notice is given?

    Is the fingerprinting requirement for AP a new requirement?

    Most importantly, is it possible to file for both EAD and AP outside the US if my I-140 was filed/approved when I was in USA? if yes, under what circumstances?

    Any inputs? Hoping a approval but god knows what it is :confused:

    As a H1B holder, can I start a new company and volunteer for it while I am holding a full-time job for the company that sponsors me the visa? I am expecting the new company to gain a profit, of course.:)

    Anybody filed your H1 ext yourself? Is it worth it?

    This will be my 12th yr extension. I have the previous extension papers (copies) that the lawyer sent me, so i was thinking i can look at those and draft a new ext myself. But with the latest news of H1 denied for consulting companies, is it worth doing it myself? I have worked for the same client for the last 11 yrs.

    Probably you got to make you aware of science of immigration. Tell the authorities what they ask for (not what you want to tell). These days merger and aquisitions are commonplace and USCIS may be aware of these situations.


    Hello all,

    My company merged with another one last year just after my I-140 was approved. I'm preparing to file I-485 (doing it myself) and I'm wondering what kind of documents/letters do I need to submit to USCIS to proof that my job wasn't affect by the merger and I'm still working in the same position.

    I'd really like to send all required information to USCIS so that I don't have to reply to RFEs later on.

    Any examples of letters or list of supporting documents will be appreciated.

    LOL..its good to have a sense of humor.

    I wish there was a way to know if a case is pre-adjudicated.

    This would help us to not file for H1 extensions, EAD, and AP. Which inturn would free up time for the officers to work on improving processing dates.

    Offcourse, i am still happy about the date movement.

    It just makes you wonder , if they USCIS was deligent in not wasting visas in previous years, even EB-3 would have had a reasonable date.

    hi gurus,

    please advise what are my options. I-140 is pending and i have 9th year H1-B expiring Dec 2009. still working for same company. in case I-140 stays pending up to December 2009. what should i do to stay in status.

    My 9th year H1B will expire in two days. My I-140 is still pending with TSC. I've sent my papers for H1B renewal. Hoping to get an extension till March 2010.
    Hang on...I-140 approval is the key for 3 year H1B extension and 2 year EAD extension.

    I am almost at the same situation.I have been here for since July 2000.Instead of getting married for american citizen I decided to go the long way.I have been changing visas from B2-H2b-F1 and now recently I apply with I140/I485.After having Masters degree in civil engineering from my country I went to school to become a nurse.After 3 years and many school I did finished and I passed the National exam for nurses but just when I was about to file for Schedule A the visa number finished and there was no chance of getting new once.Thank god they open the EB3 in July,or so I was thinking.USCIS did not separated my I140 from I 485 so I had no answer for 5.5 months.Only after I ask senators for help the thigs started moving.Finnaly I got my EAD and I can go back to saving life,which by the way I love.My advice is to marry US citized ASAP.Will save you a lot of trouble and if you love that person even better.;)

    Please help me again.
    My husband's company lawyer already filed our I-485 but I made a mistake in entering my present company detail. Basically, I'm in H1 also and my transfer is still in process , so the present company detail I entered was for my old company not my new company ( which is still in process but I already got the receipt number). I didnt' know at the time of filing which company to enter that's why. Sorry, for being clueless but I really need your advice. Thank you.

    Hello,

    I have a H1B visa stamped on my passport for Company A. This visa is valid till Nov 2008 and will need renewal after that.

    I recently changed my company from Company A to Company B. They have filed for my H1B transfer.

    Question 1] Will this new H1B for Company B be valid for 3 more years (Till Feb 2011) or will this visa have to be renewed in November 2008 (remember by visa stamp for Company A is valid till Nov 2008)?

    Question 2] What if I want to travel to India this October (remember by visa stamp for Company A is valid till Nov 2008)?? Can I still travel on my old visa stamp or will I need to go to embassy again in India for a new stamp

    If you didnt initially use your EAD to work, you should be fine because you have a valid H1B! See my other thread on this matter please.

    I send all the info including Fedex receipt to AILF for including me as plaintiff
    last week. My 485 application received by NSC on July 2 around 10 am.
    My attorney havent received it back as rejected yet.

    Gurus,

    There seem to be a positive and negative news this year for EB2s. On the one hand, USCIS surprisingly allocated all their visas last year and that means that EB2 will not receive the (20k/3) visas that they received last year.

    On the other hand because of the bad economy, one would expect that the companies will not be hiring as much EB1s and ROW EB2s as last year plus the DOL is expected to make Labor Certs very strict plus there are postings that software jobs wont make it to EB2.

    I would appreciate it if the number crunching gurus can throw any light on how the rest of this fiscal is gonna be like for EB2s.
