Immigration Law from Houston Immigration Lawyer - Annie Banerjee Has Just Posted the Following:
The justice Department's suit to block the restrictive law in Arizona is heralded by everyone as an "immigration issue." Both Wall Street Journal and New York Times have huge headings under "Immigration Law." But the question is not about immigration law. It is about the fundamental human right to not be judged by the color of our skin.
The proponents of the bill, like Arizona state Sen. Russell Pearce say that the bill "prohibits racial profiling." But I wonder if every individual is stopped and asked for their passports. The will cripple business in the State. Will everyone, ie white, black, brown, yellow, and whatever other color or look need to take their passports, birth certificates, etc to Arizona?
I naturalized into this country and is in the highest tax bracket. I work and pay taxes. Yet I am brown and have an accent. As a practitioner of immigration law, I know say for instance white Canadian who are here, in the US, working illegally, but are white and except for a slight "oot and aboot" has no other accent. Who will the Arizona police "catch"?
The lawsuit is also about separate state and federal rights. The Conservative Supreme Court will champion State rights, but it will remain to be seen whether they champion Separation of Powers. My guess is that their judgment will be clouded by the more emotional issue of immigration.

My interpretation is that that there is no appeal due to the fact she has applied early, she can apply again after the 90 day clock starts ticking and she should be good. If she gets a denial again I suggest using a lawyer, there are many on this site itself in the lawyers forum. But you seriously need to be talking about the specific type of the app if you need very precise answers because USCIS treats differnt apps well differently

Hi,
Applied for EAD renewal on 6/11/2008. Should I get it for 2 years or 1 year.
My understanding is everything that gets processed after 6/30/2008, will be for 2 years.
My PD is 6/12/2006, EB2 - which is not current right now, and I don't expect it to be current, until my I-765 gets processed (Well if it becomes current I guess I don't need 2 years :) )
Thanks for any comments/thoughts!

I did it for my wife. If your spouse plans to use H1B even after 6 years of its expiry, then having her own I-140 will help to get 3 year extensions

We had applied for an extension of my in-laws visa, and it got rejected. Is there any way we can appeal this decision?
Also, they are here a day past their I-94 expiration. Will their multiple entry visas be cancelled? They will leave within 30 days time past their I-94 expiration.

You have to go through the same process as a New H1B and it stamped in INDIA again and also get in touch with your new employer he should be able to give you the info you need. Their is no new form to be filled in.

A friend of mine told me that we do not have to pay Social Security Tax while working on EAD. Does anybody know if this is true ?
That would be a huge plus in case its true.
Your friend may have confused 485 based EAD with F1 OPT based EAD. On F1, you do not pay SS or Medicare. On AOS based EAD, you do need to pay SS/Medicare taxes.

I-130 does play a role, when applying for visitors visa. but that doesnt disquialify anyone from getting visa. you have to show string ties to your country and provide enough evidence that you will come back. there are cases where they hv granted 10yrs multple visas !!

Hi,
I need some clarification regarding my case,
--> Got H1b approved for Employer A in 2008, during stamping received 221G.
--> Submitted documents in 2009 and got stamping done in May 2009.
--> Now Employer B has applied for fresh H1B 2010.
My questions are,
When my petition is approved and having the petition in my hand, do i need to get the visa stamping before travelling for Employer B?:mad:
Will my visa stamp for Employer B only have the starting date to be from October 2011?:mad:
Is there any remote possibility that i can travel for my Employer B at any time earlier to October 2011?:mad:
Note: Have never travelled on H1 (Employer A's Petition)

when we go for finger printing will they ask for the A#. If so, do we need to provide the one with the 0 that is on the FP notice or the one with out the 0 (this is on the 485 receipt)
